General Terms and Conditions

Pameco offers as an operator of different pay-content websites to  customers the possibility to see the contents of the Internet sites and  to download the available photos and videos. Condition for the claim of the achievements of PAMECO by the customer is his membership. Furthermore offers PAMECO to customers the possibility to acquire goods or to take part in workshops.

§ 1 Realisation of the membership contract
 
1.  PAMECO offers the possibility on his websites to become a member.
2.  For this are necessarily the input of the data by the customer, the choice of one of the available payment procedures,
     the recognition of the Terms and Conditions and the sending of the suitable form.
3.  Up to sending the form the customer has any time the possibility to extinguish the given data or to correct.
4.  Member can become only who is at least 18 years old, of full age and is able of business. By the recognition of the
     Terms and Conditions the customer expressly declares to be this. On inquiry of PAMECO the customer is obliged to
      prove his majority by suitable identification papers. 
5.  By sending the form the contract comes about between the customer and PAMECO.
6.  After entrance of the payment, see §3, the access to the respective website is activated for the customer as a member. 
7.  PAMECO points out the customer expressly to the fact that the cancellation right being entitled to him expires
     according to §312 d III BGB by sending the form, because he arranges through this PAMECO for the implementation
     of the service before the end of the cancellation term.

§ 2 Contract term, notice

1.  The customer can choose with contract end between three subscription variations: one-month, 3-month and 6-month. 
2.  The contract term amounts according to the variation one, three or six months. 
3.  The contract can be discontinued any time  in writing (by e-mail, fax or letter). With the one-month
     subscription variation at the earliest at the end of the subsequent month, otherwise at the end of the respective
     contract term. Please call on this occasion your registered e-mail-address. If no notice occurs, the contract is
     automatically extended by another one, three or six months.
4.  The right to the extraordinary notice for important reason remains untouched from this. An important reason is given
      in particular when  
     - the customer gives a false name, a wrong e-mail address or wrong payment data with the registration, or 
     - offends culpably against his duties arising from these Terms and Conditions.

§3 Payment of the membership contribution

1.  PAMECO uses for the handling of the payment the services of the Heidelberg Payment GmbH as a representative.
2.  PAMECO makes available on his sides alternatively the payment by debit or by credit card. 
3.  By choice of the payment kind and sending the form the customer authorises PAMECO or respectively his
     representative to load the account or the credit card according to the elective term periodically. 
4.  The customer undertakes to provide for a sufficient cover of his account. PAMECO is entitled to charge for costs by
     resulted back debits or back reservations to the customer, as far as the customer has been to blame for this.

§4 Duties of the customer

1.  The customer is obliged to inform of all necessary data properly and completely at the time of registration. Changes
     are to be informed to PAMECO or the Heidelpay GmbH by change of the payment data immediately. 
2.  The customer undertakes to take into account the principles of the data security and to protect passwords against
     access of unjustified third. 
3.  The access to the website is personal and untransferable. It is prohibited to gain the access to the website for third. The
     customer has to provide in particular for the fact that the contents of the websites are not observable for persons under
     age. The customer is responsible for every use of the websites which occurs under use of his access data. 
4.  The customer may use the down loaded stories, photos and videos exclusively and for private purposes. A
      publication, particularly in forums, is expressly prohibited.
5.  The number of the downloads per set is limited to three. This is for the purpose of the security and the protection
     before to unjustified accesses necessarily.

   
§5 Liability

1.  PAMECO assumes no liability for the completeness and correctness of the personal information of the models. 
2.  PAMECO assumes no liability for impossibility, bad achievement or delay with the achievement, provided that the
     damage cause is not based on intention or coarse carelessness. 
3.  Legally compelling liability regulations remain untouched from this.

§6 Data protection regulations

1.  Herewith the customer is informed according to TDDSG and BDSG about the fact that his data are stored
     electronically and are processed, as far as this is necessary for the proper contract fulfilment. 
2.  A passing on to third parties occurs exclusively for the purposes linked with the contract. PAMECO obliges in this
     respect the third to treat the data confidentially and to extinguish immediately if they are not necessary for the contract
    fulfilment any more. 
3.  The customer can require any time by e-mail a communication about the data stored by him. 
4.  PAMECO will extinguish the data of the customer, as soon as the contract relations have been finished and out of this
    no more other obligations or legal results result.

§7 Final regulations

1.  Legal basis for everybody on basis of these Terms and Conditions to proving contracts is the German right. 
2.  Provided that legally allowed the legal venue for all disputes arising from this contract is Königstein, Germany. 
3.  Should one of the preceding regulations be ineffective partially or completely, that legally effective regulation which
     comes in her purpose and contents most near the ineffective regulation should step to her place. The effectiveness of
     the remaining regulations remains untouched from this. 
4.  PAMECO reserves the right to modify these Terms at any time and without giving any reasons to change. A change
     in the conditions, the customer is informed about beforehand. Does the member of the validity of the new Terms and
     Conditions  not contradict within two weeks after the note, the amended GTC shall be deemed adopted. If, despite
     opposition the customer's contract continuation under the old conditions no longer possible, the ciustome has the right
     to extraordinary  termination. PAMECO will notify the customer informed about these consequences.
5.  These Terms and Conditions are available to be down loaded by the customer any time on the websites of      
     PAMECO.
